An APOSTILLE authenticates a document’s origins for use in another Hague Convention member country — a one-step certification issued by the Tennessee Secretary of State.
An AUTHENTICATION is a more complex, three-step process required for documents destined for non-Hague member countries — involving the state, the U.S. Department of State, and the destination embassy.

Critical Details That Affect Your Apostille – What a Notary Can & Cannot Do
📄 Certified Copies
State law does not authorize a notary to certify a copy of your document. Only the person to whom the document was issued can certify in a written statement that a photocopy is a true copy — signatories then obtain notarization under oath. For some documents, an original custodian (e.g., a school registrar) must sign the statement in the presence of a notary. ARTSA’s on-call and online notary is available for this.
🚫 Documents That Cannot Be Notarized
Vital records — birth certificates, death certificates, marriage/divorce certificates — court documents, company registration records, and FBI background checks cannot be notarized by a notary public. Submitting a notarized version of these documents will lead to rejection. (One exception: vital records from New Hampshire must be notarized before sending for apostille.) ARTSA will identify the correct path for your specific document type.

🌐 Why Translation? Countries including Germany, France, Italy, South Korea, Japan, Brazil, and many others require submitted documents in their official language. A certified translation — accompanied by a notarized accuracy statement from the translator — satisfies this requirement. ARTSA coordinates this step through ATA-certified translators in 150+ languages.

IMPORTANT NOTES BEFORE WE BEGIN!
📌 All apostille documents must be notarized first
…with very specific exceptions. Any documents already notarized should be carefully reviewed for correct form before submission. ARTSA will verify this as part of your consultation.
🖊️ Wet ink vs. digital signatures
ARTSA cannot guarantee that the destination country will accept an electronic signature in place of a wet ink signature. If requesting online notarization in connection with acquiring an apostille, it is the client’s sole responsibility to ascertain whether the destination country accepts electronic signatures. ARTSA will assist in researching this — but the final confirmation must come from the receiving authority
📎 Physical document requirements
The recipient government, university, USCIS, or embassy may require physical documents with original seals, staples, and stamps permanently attached upon receipt. To prevent unexpected delays, please inquire about this critical detail — it varies significantly between foreign countries. ARTSA will help you ask the right questions.
⚖️ ARTSA is not a law firm
Neither ARTSA Notarial Services nor its notary represents or is an attorney licensed to practice law in Tennessee or any other state, and may not give legal advice or accept fees for legal advice. ARTSA provides paralegal-informed notarial and apostille facilitation services only.
